General Terms and Conditions HITrental AG
In the following we would like to introduce you to our general terms and conditions, which we use as a basis for processing and handling your booking.
We offer apartments for short and long-term stays. The general terms and conditions for short-term stays apply for a stay of 1 to 30 nights. The terms and conditions for long-term stays apply to stays longer than 30 nights.
Please read our General Terms and Conditions carefully.
1 Short-term Stays (1-30 nights)
1.1 Object of the Agreement
HITrental AG rents the apartment booked by the guest for private use; business use is only permitted with the express permission of HITrental AG.
1.2 Reservations and Bookings
For a definite reservation of an apartment a down payment of 50% of the total amount must be paid. If the availability of the desired apartment has been confirmed by HITrental AG, the down payment can be paid by credit card or with bank payment (bank transfer is only possible in case the check in date is at least 7 days ahead). A booking is not binding until the down payment has been received by HITrental AG. The guest agrees to provide full details of his valid credit card at the time of booking. In case HITrental AG is not able to provide the guest with the apartment he/she booked, the company reserves the right to accommodate him/her in an equivalent apartment. If there is no agreement, both parties are entitled to dissolve the contract. In this case, HITrental AG will refund the tenant all amounts already paid (except for the days that may have already been used). HITrental AG is not liable for any further claims.
1.3 Payment and Credit Card Payment
The balance of 50% of the total price is due on the day of arrival. This amount must be paid by credit card or in advance by bank transfer. The total price of the apartment can also be paid in advance in full by credit card or bank transfer in consultation with HITrental AG. In case of bank transfer, the corresponding amount must be received and confirmed by HITrental AG one week before the arrival date. Unless otherwise agreed, HITrental AG is entitled to charge the outstanding and due amount to the guest's credit card on the day of arrival. HITrental AG reserves the right not to hand over the keys until the full amount has been paid. HITrental AG reserves the right to demand a deposit from the guest at the start of the rental period as security for the payment of rent, for any damage to the apartment or the furnishings.
For foreign currency transfers, the following conditions apply: All fees arising from exchange rates and foreign currencies must be borne by the guest. The guest is responsible for ensuring that the full required amount is received in Swiss Francs (CHF) in our account. Any discrepancies due to exchange rate fluctuations or bank fees must be covered by the guest.
1.4 Cancellation
Cancellation is possible up to 7 days before arrival.
- Less than 7 days before arrival: 50% of the total amount
- No-show (non-arrival): The total amount will be charged (not to exceed one month’s rent)
All cancellations must be made by email. Cancellations or changes by telephone will not be accepted. The guest authorizes HITrental AG to debit the credit card specified at the time of booking in the event of cancellation. HITrental AG recommends that you take out travel insurance.
1.5 Outstanding Balance and Termination of the Agreement
By accepting these GTCs, the guest expressly agrees to provide HITrental AG with his credit card details and expressly agrees that any payment arrears may be debited from his card account by HITrental AG within one day after the due date. Should the guest, contrary to this agreement, not have provided a valid credit card or should the debiting of the credit card not be possible for other reasons, HITrental AG is entitled to vacate the apartment 10 days after the due date of payment and to sublet it to another party. The personal belongings of the guest will be kept for 60 days and can be collected during this time against payment of all outstanding payments. Additional costs incurred due to the guest's misconduct (costs for changing the lock, etc.) will be charged additionally.
1.6 Security Deposit
HITrental AG reserves the right to request a deposit/deposit from the guest for any damage to the apartment or furnishings. A possible deposit can be paid by bank transfer or credit card and will be fully refunded (refund on credit card or by transfer to the account indicated by the guest within 10 days) if the apartment is returned in good and undamaged condition.

1.7 Loss of Keys
All keys received must be returned at check-out. In case of lost keys, we reserve the right to charge between CHF 150.00 and CHF 400.00 for changing the lock or replacing the keys (depending on the building), for the security of the next tenant.
1.8 Arrival
Check-in generally takes place between 15:00 and 23:59. An earlier check-in can be arranged under certain circumstances. You may also be able to leave luggage until the apartment is ready to move in. Contact our booking team if needed.
1.9 Departure
Check-out is at 11:00 am at the latest. At departure, the guest has to leave all received keys on the table and close the door behind him. The apartment is to be left in a tidy condition, the dishes cleaned, and the garbage disposed of. If the apartment is left in such a bad condition that a usual final cleaning is not enough, an additional cleaning fee of CHF150.- will be charged.
1.10 Number and Identity of Guests
In the apartment may not be accommodated more than the maximum number of people indicated on the website. HITrental AG must be informed about the number and identity of the guests. Only persons who are registered with us may use the apartment. The number of guests must not exceed the maximum number of guests indicated for each apartment, except for children under 2 years old. Pets are allowed only on request and with the corresponding explicit confirmation from HITrental AG. An additional fee will be charged. The exact costs per night and pet will be communicated to you at the time of booking and with the authorization for the pet. HITrental AG reserves the right to cancel the contract and to expel the guests from the apartment without compensation if these conditions are not respected.
1.11 Behaviour During your Stay
The guest undertakes to be considerate of the other guests and tenants when using his apartment and to observe the house rules. Smoking in the apartment is strictly prohibited. In case of disregard of the smoking ban a fine of CHF 500.00 will be charged. If the apartment has a balcony, it is allowed to smoke on the balcony with the balcony door closed.
Noise disturbances are to be avoided and the quiet hours are to be strictly observed. Quiet time is every day from 22:00 to 08:00. HITrental AG reserves the right to expel guests who do not comply with these rules from the apartment at any time, in which case the guest will not be entitled to any compensation. In case of business use of the apartment without express permission, HITrental AG reserves the right to dissolve the contract immediately, without compensation from the guest.
1.12 Liability
Neither HITrental AG nor the owners of the apartments are liable for any direct or indirect damage resulting from use by the tenant, including damage, fire damage, robbery and criminal offenses.
HITapartments AG assumes no liability for fire alarms triggered by the improper use of kitchen appliances or other potential fire hazards. If a fire alarm is activated due to such incidents, the full responsibility, including any costs incurred for the deployment of fire and emergency services, lies with the party responsible. Guests are urged to use kitchen appliances and all other electrical devices carefully and in accordance with the instructions to ensure everyone's safety and avoid unnecessary expenses.
1.13 Our Website
All apartment descriptions and information can be found on the listed apartments on our website. While and although HITrental AG does its best to maintain accuracy and always keep details up to date, HITrental AG cannot be held liable for any errors or omissions made by third parties. HITrental AG also reserves the right to change information published on the website at any time, including rates, descriptions and photos. HITrental AG cannot accept any responsibility for the accuracy of any product or service descriptions on this website. HITrental AG reserves the right to change or renew its terms and conditions at any time if the well-being and requirements of the company so require. It is the responsibility of all parties using the site to take adequate measures to ensure that the Terms and Conditions have been read.
1.14 Applicable Law and Court of Jurisdiction
Swiss law applies. Should individual points of the General Terms and Conditions be void or violate applicable law, this shall not affect the validity of these General Terms and Conditions. For void and against the valid right offending conditions the legal regulations come instead into force. The place of jurisdiction for all disputes in connection with the accommodation contract and the General Terms and Conditions is Luzern.
2 Long-term Stays (From 30 nights)
2.1 Object of Agreement
HITrental AG rents the apartment booked by the guest for private use; business use is only permitted with the express permission of HITrental AG.
2.2 Reservations and Bookings
The entire first month's rent or the share for the nights booked in the first month, is due on the day of booking or on the day of signing the contract, but no later than 7 days after booking/contract signing.
The fee for the final cleaning is CHF 200.00. This final cleaning fee is due with the first month's rent. The security deposit is CHF 2000.00. The security deposit is due with the first month's rent. The amount for the 1st month's rent or for the share for the nights booked in the first month plus final cleaning fee and deposit can be paid by bank transfer or credit card.
For foreign currency transfers, the following conditions apply: All fees arising from exchange rates and foreign currencies must be borne by the guest. The guest is responsible for ensuring that the full required amount is received in Swiss Francs (CHF) in our account. Any discrepancies due to exchange rate fluctuations or bank fees must be covered by the guest.
“Serafe” radio and TV tax is not included in the rent and must be paid by the tenant.
The total price of the apartment can also be paid in advance in full by credit card or bank transfer in consultation with HITrental AG. HITrental AG reserves the right to maintain the booking only if the 1st monthly amount or the share of the booked nights for the 1st month has been received in time (according to the contract) on the bank account. The further monthly payments are always to be paid in advance in full for the next month. The corresponding amount must be received in the account of HITrental AG on the last day of the previous month. If the payment of the following month has not been paid in full, HITrental AG is entitled to vacate the apartment 10 days after the due date of payment and to sublet it elsewhere. The personal belongings of the guest will be kept for 60 days and can be collected during this time against payment of all outstanding payments. Additional costs incurred due to the guest's misconduct (costs for changing the lock, etc.) will be charged additionally.
If HITrental AG is not able to provide the guest with the apartment he/she booked, the company reserves the right to accommodate him/her in an apartment of equal value.
2.3 Confirmation of residence
● After registering with the city's residents' registration office, a copy of the confirmation of residence received from the city must be sent to us no later than 7 days after receipt.
● Failure to deliver the confirmation of residence on time may result in the termination of the tenancy.
2.4 Cancellation
Free cancellation is possible up to 30 days before arrival.
- Less than 30 days before arrival: The amount of 1 month rent will be charged.
- No-show (non-arrival): The total amount will be charged (not to exceed one month’s rent)

For bookings longer than 30 nights, a deposit of CHF 2000.00 is due. This is to be transferred with the first month's rent or the share for the nights booked in the first month and must be received in the account of HITrental AG no later than 7 days after signing the contract/booking. The refund of the deposit will be made by HITrental AG no later than 10 days after the end of the rental period, if the apartment was left in good and undamaged condition.
2.7 Loss of Keys

2.9 Contract termination
The cancellation notice period is 1 month. If a cancellation is required by the tenant, it needs to be advised at least 1 month ahead.
2.10 Departure

The apartment is cleaned once a month for stays longer than 45 days (incl. towels and bed linen). Additional intermediate cleaning can be booked for a fee. The staff of the cleaning service has permission to enter the apartment (even in the absence of the guest) for the purpose of cleaning. The same applies to our house technicians in case of necessary repairs. All utilities, monthly intermediate cleaning (from a stay longer than 45 nights), TV (except Serafe fee) and Internet are included in the price. In case of failure or malfunction of the Internet, the guest cannot ask for a reduction of the price. For pets there is an additional fee per night and pet and a deposit.
